1Overview

This DMCA & Copyright Policy ("Policy") explains how Farfetched Media Labs Pvt Ltd ("Farfetched Media Labs," "Zazu," "we," "us," or "our") responds to claims that content uploaded to, generated through, or made available via the Zazu platform at zazu.video and our related applications and extensions (collectively, the "Services") infringes copyright.

Zazu respects the intellectual property rights of others and expects users of the Services to do the same. We respond to clear and complete notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512, the "DMCA") and, where applicable, other relevant laws.

This Policy forms part of, and should be read together with, our Terms of Service, Acceptable Use Policy, and Privacy Policy.

2Important Notice Before You Send a Notice

Submitting a DMCA notice is a legal action with serious consequences. Before you send a notice, please consider the following:
  • Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that it was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees.
  • Fair use, fair dealing, licence, consent, parody, criticism, commentary, news reporting, education, and research are valid defences to a claim of copyright infringement. If you are unsure whether the use you are reporting is infringing, consult an attorney before sending a notice.
  • Notices and counter-notices are legal documents. The information you provide (including your name and contact details) may be forwarded to the user who posted the content, and may be published in transparency reports or third-party repositories (such as the Lumen database).

3Definitions

Term Meaning
Complainant A copyright owner, or a person authorised to act on behalf of a copyright owner, who submits a takedown notice under this Policy.
User Any registered or unregistered user of the Services whose content is the subject of a takedown notice.
User Content Any video, audio, image, text, prompt, transcript, or other material uploaded, imported, generated, or made available by a User through the Services.

4Filing a DMCA Takedown Notice

If you are a copyright owner (or authorised to act on behalf of one) and you believe that User Content accessible through the Services infringes your copyright, you may submit a written notice to [email protected]. To be effective under the DMCA, your notice must include substantially the following:

  1. A physical or electronic signature of the person authorised to act on behalf of the owner of the exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or — if multiple works at a single online site are covered by a single notice — a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit Zazu to locate the material (for example, a direct URL to the clip, project, or shared link, the user account associated with it, and any timestamps within the video).
  4. Information reasonably sufficient to permit Zazu to contact you, such as your full legal name, mailing address, telephone number, and, if available, an email address at which you may be contacted.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owne, or the law.
  6. A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.

Incomplete notices. If your notice does not substantially comply with the requirements above, we may be unable to act on it, and we may ask you for additional information before doing so.

5Our Response to a Notice

Upon receipt of a notice that substantially complies with the requirements of Section 4, Zazu will:

  • Promptly remove, disable access to, or otherwise restrict the material including, where applicable, disabling public sharing links identified in the notice
  • Take reasonable steps to notify the User who posted the material that the material has been removed or disabled, including by forwarding a copy of the notice (with the Complainant's contact information) to that User
  • Maintain a record of the notice in accordance with our internal procedures

Zazu is not in a position to adjudicate copyright disputes. The removal of material in response to a notice does not mean that we agree the material is infringing, nor does it constitute legal advice or a legal determination.

6Counter-Notice

If you are a User and your content has been removed or disabled in response to a DMCA notice, and you believe in good faith that the removal was the result of mistake or misidentification, you may submit a counter-notice to [email protected]. To be effective, a counter-notice must include substantially the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your full legal name, mailing address, telephone number, and an email address at which you may be contacted, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Zazu may be found), and that you will accept service of process from the Complainant.

6.1 What Happens After a Counter-Notice

Upon receipt of a counter-notice that substantially complies with the requirements above, Zazu will:

  • Promptly provide the Complainant with a copy of the counter-notice and inform them that we will restore the removed material in not less than ten (10) and not more than fourteen (14) business days
  • Restore the removed material, or cease disabling access to it, within that timeframe, unless the Complainant first notifies [email protected] that they have filed an action seeking a court order to restrain the User from engaging in infringing activity relating to the material

7Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Zazu has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of Users who are determined to be repeat infringers. We may also, at our sole discretion, limit access to the Services or terminate the account of any User who infringes any intellectual property rights of others, whether or not there is any repeat infringement.

Factors we may consider in identifying repeat infringers include the number and nature of notices we have received regarding a User's account, the User's response to counter-notice opportunities, the outcome of any legal proceedings, and the overall pattern of activity associated with the account.

8Misuse of the Notice or Counter-Notice Process

Zazu reserves the right to seek damages, including attorneys' fees, from any Complainant or User who knowingly and materially misrepresents information in a DMCA notice or counter-notice, in accordance with 17 U.S.C. § 512(f). We may also restrict or terminate the account of any person who repeatedly submits notices or counter-notices in bad faith.

9AI-Generated Outputs and Source Materials

Because Zazu is an AI-powered clip-generation platform, complaints may relate to:

  • Source videos uploaded or imported by Users (for example, a long-form video imported from a third-party platform without authorisation)
  • AI-generated clips, captions, transcripts, summaries, or other outputs derived from source material
  • Style presets, templates, or visual elements made available by Users or third parties

Where a notice identifies an AI-generated output, we will treat it as a notice in respect of the User Content that produced the output (including the source material and any derived clips), and we may remove or disable access to both the source material and the derived outputs.

Zazu does not pre-screen User Content for copyright compliance. Users are responsible for ensuring that they have all necessary rights, licences, and permissions for any content they upload, import, or generate through the Services. Zazu acts as an intermediary platform and does not claim ownership over User Content uploaded or generated by users.

10Public Domain, Licences, and Other Defences

Material that is in the public domain, used under a valid licence (including a Creative Commons licence with applicable conditions complied with), used with the permission of the copyright owner, or used under fair use, fair dealing, or another applicable exception, is generally not infringing. If you believe your content was removed in error on any such ground, you may submit a counter-notice under Section 6.

11No Legal Advice

This Policy is intended to summarise our procedures for responding to copyright complaints. It is not legal advice and does not create any contractual or statutory rights beyond those provided by applicable law. If you are unsure of your rights or obligations, you should consult a qualified attorney.

12Changes to This Policy

We may update this Policy from time to time to reflect changes in our practices, technologies, legal requirements, or business operations. When we make material changes, we will update the "Last Updated" date above and, where appropriate, provide notice through the Services or by email. The version of the Policy in effect at the time we receive a notice will apply to that notice.
